1. INTRODUCTION
Welcome to Rent-in-France.co.uk, a website owned and operated by Holiday Rental Properties Ltd ("Rent-in-France").
Since 2007, Rent-in-France has specialised in promoting holiday rentals, chambres d'hôtes, luxury properties and event venues throughout France. Our aim is to provide a trusted platform that connects guests directly with property owners and agents, helping both parties communicate openly and arrange bookings with confidence.
By advertising with Rent-in-France, using the website or accessing any services provided by Rent-in-France, you agree to be bound by these Terms of Trading.
2. OUR ROLE
Rent-in-France primarily operates as an online advertising and marketing platform for holiday rental properties, chambres d'hôtes and event venues located throughout France.
The standard service provided by Rent-in-France enables direct communication between property owners, agents and prospective guests. In most cases, enquiries, bookings, rental agreements, payments, deposits, cancellations and guest communications are handled directly between the owner or agent and the guest.
However, where specifically requested by an owner, agent or authorised representative, Rent-in-France may provide intermediary services. These may include introducing prospective guests, assisting with enquiries, facilitating communications, supporting booking arrangements or undertaking promotional activities on behalf of the owner.
Any intermediary service provided by Rent-in-France shall be subject to a separate written agreement, email confirmation or commission arrangement.
Unless expressly agreed otherwise in writing, Rent-in-France is not a travel agent, tour operator, property manager or party to any rental contract.
3. PROPERTY LISTINGS
Property owners and agents are responsible for ensuring that all information supplied to Rent-in-France is accurate, complete and up to date.
This includes, but is not limited to:
- Property descriptions
- Rental rates and pricing
- Availability information
- Photographs and images
- Facilities and amenities
- Occupancy limits
- Event venue information
- Location details
- Contact information
Owners and agents agree to notify Rent-in-France promptly of any material changes affecting their listing.
Rent-in-France reserves the right to edit, amend or improve listing content for presentation, formatting, marketing or search engine optimisation purposes whilst maintaining the accuracy of the information provided.
4. OWNER AND AGENT RESPONSIBILITIES
Property owners and agents warrant that:
- They have the legal authority to advertise the property or venue.
- The property complies with all applicable local and national laws.
- Appropriate insurance cover is maintained.
- Any licences, registrations or permissions required by law are held.
- The property is safe and suitable for occupation by guests.
- All information supplied is truthful and accurate.
Owners and agents remain solely responsible for:
- Guest communications
- Rental agreements
- Collection of payments
- Security deposits
- Refunds and cancellations
- Property maintenance
- Compliance with applicable laws and regulations
4A. QUALITY STANDARDS AND TRUST
Since 2007, Rent-in-France has been committed to promoting quality holiday accommodation and event venues throughout France.
Whilst Rent-in-France cannot personally inspect every property advertised on the website, every effort is made to maintain high standards and provide a reliable advertising platform for both guests and property owners.
Rent-in-France reserves the right to refuse, suspend or remove listings that may not meet the standards expected by visitors to the website.
Owners and agents are encouraged to provide accurate descriptions, current photographs, transparent pricing and prompt communication with prospective guests.
Where concerns are raised regarding a property, venue or advertiser, Rent-in-France reserves the right to investigate and take appropriate action, including requesting additional information, updating listing content or removing the listing where necessary.
5. LISTING FEES AND COMMISSION ARRANGEMENTS
Rent-in-France normally charges an upfront advertising fee for the promotion of properties and venues.
Advertising fees are payable in advance and are non-refundable once a listing has been activated, published or renewed, unless otherwise agreed in writing.
In certain circumstances, Rent-in-France may agree to promote a property or venue on a commission basis instead of, or in addition to, an advertising fee.
Where a commission arrangement applies:
- The commission terms must be agreed in writing.
- Commission becomes payable upon completion of a booking, referral, introduction or other agreed transaction.
- Owners and agents agree to honour any commission agreement entered into with Rent-in-France.
Failure to pay agreed fees or commission may result in suspension or removal of listings and recovery of outstanding amounts.
6. ENQUIRIES, BOOKINGS AND INTRODUCTIONS
Rent-in-France cannot guarantee:
- A specific number of enquiries
- A specific number of bookings
- Occupancy levels
- Revenue or profits
- Search engine rankings
- Website traffic levels
- Marketing performance
Results will vary depending on location, pricing, availability, property quality, competition, market conditions and factors beyond the control of Rent-in-France.
Where Rent-in-France introduces or refers a prospective guest to an owner or agent under a commission arrangement, any agreed commission remains payable if a booking results from that introduction.
Owners and agents agree not to deliberately circumvent or avoid agreed commission arrangements.
6A. BOOKING SECURITY AND GOOD FAITH
Rent-in-France aims to provide a trusted environment in which guests may contact owners and agents directly.
Owners and agents agree to conduct all communications honestly, professionally and in good faith.
Guests are encouraged to undertake reasonable checks before making payments, including reviewing property information, requesting confirmation of booking details and ensuring that payment instructions originate from the owner or authorised agent.
Rent-in-France may, at its discretion, assist owners and guests in resolving misunderstandings or communication issues, although Rent-in-France is under no obligation to mediate disputes.
6B. COMMISSION INTRODUCTIONS AND REFERRALS
Where Rent-in-France introduces, refers or assists in securing a booking on behalf of an owner or agent under a commission arrangement, the owner or agent agrees that any resulting booking shall be deemed to have originated from Rent-in-France.
Commission shall remain payable where a booking is made directly or indirectly as a result of such introduction, referral, communication or marketing activity.
This provision is intended solely to protect agreed commercial arrangements and does not affect the contractual relationship between the owner or agent and the guest.
7. RENTAL AGREEMENTS
All rental agreements are entered into directly between the property owner (or agent) and the guest unless otherwise agreed in writing.
Rent-in-France accepts no responsibility for:
- The performance of rental agreements
- Guest behaviour
- Property condition
- Payment disputes
- Cancellations
- Refund claims
- Travel disruptions
- Property damage
Guests and owners are encouraged to obtain appropriate travel and property insurance where applicable.
8. WEBSITE CONTENT AND COPYRIGHT
Owners retain ownership of photographs, text and materials supplied for their listings.
By supplying content to Rent-in-France, owners grant Rent-in-France a non-exclusive licence to:
- Display content on the website
- Use content in marketing campaigns
- Publish content in newsletters
- Promote listings on social media
- Use content for advertising and search engine optimisation purposes
Owners confirm that all submitted content is owned by them or that they have permission to use it.
9. AVAILABILITY CALENDARS
Owners are responsible for maintaining accurate availability information.
Where calendar synchronisation tools, iCal feeds or third-party integrations are used, Rent-in-France cannot guarantee uninterrupted synchronisation and accepts no liability for resulting double bookings, errors or omissions.
10. LIMITATION OF LIABILITY
Rent-in-France shall not be liable for:
- Loss of bookings
- Loss of profits
- Loss of business opportunities
- Guest disputes
- Property damage
- Fraudulent enquiries
- Website interruptions
- Technical failures
- Data transmission errors
- Search engine ranking fluctuations
To the fullest extent permitted by law, the total liability of Rent-in-France shall not exceed the amount paid by the owner or agent for the current advertising period.
11. INDEMNITY
Owners and agents agree to indemnify and hold harmless Rent-in-France, Holiday Rental Properties Ltd, its directors, employees and contractors against any claims, actions, damages, losses, liabilities, costs or expenses arising from:
- Their property listing
- Information supplied by them
- Rental agreements
- Guest complaints
- Breach of applicable laws
- Intellectual property infringement
12. CUSTOMER FEEDBACK AND COMPLAINTS
Rent-in-France values feedback from guests, owners and agents.
Where credible complaints are received regarding a listing, service standards, communication, property condition or booking practices, Rent-in-France reserves the right to contact the advertiser and request clarification.
Repeated, serious or unresolved complaints may result in the suspension or removal of a listing where Rent-in-France believes such action is necessary to protect guests, owners or the reputation of the platform.
Where appropriate, advertisers will normally be given a reasonable opportunity to respond before action is taken.
13. REMOVAL OF LISTINGS
Rent-in-France reserves the right to refuse, suspend, edit or remove any listing where:
- Information is inaccurate or misleading
- Fees remain unpaid
- Complaints raise serious concerns
- The advertiser breaches these Terms
- Continued publication may damage the reputation of Rent-in-France
No refund shall be due where a listing is removed as a result of a breach of these Terms.
14. RENEWALS AND CANCELLATIONS
Advertising subscriptions are provided for the period purchased and do not automatically renew unless otherwise agreed.
Owners and agents may choose whether or not to renew their advertising at the end of the subscription period.
No refunds shall be payable for unused portions of advertising periods once a listing has been activated or renewed, except where required by law or expressly agreed by Rent-in-France in writing.
15. PRIVACY AND DATA PROTECTION
Personal information shall be processed in accordance with the Rent-in-France Privacy Policy and applicable UK data protection legislation.
Users agree that Rent-in-France may store and process information necessary for the operation, promotion and administration of its services.
16. CHANGES TO THESE TERMS
Rent-in-France reserves the right to amend these Terms of Trading at any time.
Updated versions will be published on the website and shall take effect immediately upon publication.
17. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
